Divorce cannot be sought on the ground of wife not being able to bear child: Calcutta High Court

Calcutta High Court Statement On Divorce: If the wife cannot give birth to a child, then divorce cannot be sought from her on the basis of this. The Calcutta High Court has said this. The court said that this cannot be a valid ground for divorce. At the same time, the court also said that seeking divorce on the ground that a wife who is already in distress due to childlessness, amounts to mental cruelty under section 498A of the IPC.

Justice Shampa Dutt Pal said, “There are many options to become a parent. On such occasions, the husband/wife should show understanding because only he can help his partner to stand again mentally, physically and emotionally. So that They can face the world, especially the society, bravely together.”
