Calcutta High Court Statement On Divorce: If the wife cannot give birth to a child, then divorce cannot be sought from her on the basis of this. The Calcutta High Court has said this. The court said that this cannot be a valid ground for divorce. At the same time, the court also said that seeking divorce on the ground that a wife who is already in distress due to childlessness, amounts to mental cruelty under section 498A of the IPC.
Justice Shampa Dutt Pal said, “There are many options to become a parent.
